    Inclusive Development International's Natalie Bugalski was in Dublin last week, speaking at the launch of the Dublin Declaration on Fair and Equitable Land Access (FELA). A work in progress, the Dublin Declaration, or FELA 1.0, proposes a new approach to negotiating land use and access when development projects threaten to displace local communities—one that treats affected people as partners rather than externalities. At the launch, Natalie spoke to issues of accountability and remedy, underscoring that harms caused by displacement need to be avoided in the first place, by ensuring that communities have a genuine role in decision-making, including about whether and on what terms a project proceeds. She proposed that intensive community-company mediations, typically only pursued as part of efforts to repair harm after its done, should be used at the outset to reach agreement on the terms of land access before projects begin. And she stressed that these community-company agreements must be legally binding and enforceable by communities themselves, either through courts or arbitration, so that communities are in a position to hold project developers directly accountable if and when harms occur. Launching the FELA Declaration 1.0 is just a first step—we are looking forward to the input of civil society and communities to formulate a clear new approach demanding that project developers, including mining companies that aim to supply metals and minerals for the clean energy transition, treat communities with respect and move forward with projects on their land only with their agreement. As Natalie told the audience of impact assessors in Dublin, “there is no doubt that a fundamentally different approach that centers the rights of affected communities is urgently needed.” https://lnkd.in/eqR2r3hh
